INDUSTRY FOCUS
Is Your Organization Providing Reasonable Standards of Care?

Risk analysis can limit premise liability.

While premises owners are not the insurers or guarantors of their invitees', tenants’, patrons’ or visitors’ safety,  the duty imposed on facility managers and premise owners is to provide a safe and secure environment, while providing reasonable standards of care. When an owner fails to exercise reasonable care and, as a result, someone who is lawfully on the premises is injured, the property owner may be held liable.

Now the good news— there are ways to limit liability by being aware of your premise risk profile and developing and implementing policies, procedures, and protocols that will either prevent or deter risk that is reasonably foreseeable.

Protection in today’s economy, with shrinking budgets and the complex nature of the rapidly changing threat land-scape, calls for a carefully developed and expertly delivered enterprise assessment of the threats most likely to create liability and exposure.  Once those physical, informational and personnel vulnerabilities are identified, mitigation strategy based on those threats most likely to harm the continued operations of the enterprise can be outlined and appropriately budgeted for.

While crime rates have generally decreased during the past few years, certain industries tend to generate particular vulnerabilities. For example, Andrews International serves a number of customers in the shopping center industry, where our security staff has responded to a rash of attempted burglaries of motor vehicles. Due to awareness of the issues involving this particular crime trend, our security programs at these properties have specific procedures in place to help prevent, deter and respond to this risk, as described in the success stories below.

AI Officers Catch "The Tourist Bandit"

Two Andrews International security officers, Sergeant Solomon Patton and Officer George Islas, responded when they saw a male suspect being chased by another male who yelled that he had been robbed. Patton and Islas followed, and the victim caught up to the suspect on Vine Street. The suspect then pulled a knife on the victim, and subsequently threatened Officer Patton. Officer Patton told the suspect that he would have to use a Taser if the suspect did not submit to arrest. Islas covered the suspect with his handgun. The suspect then dropped the knife and was taken into custody without further incident. LAPD then came to take custody of the suspect, who was later identified as Rex Lutton, aka “The Tourist Bandit,” who is suspected of committing two bank robberies, one in Venice and one in West Hollywood, the week previous.  Lutton was a parolee at large who was wanted by the FBI.

Hollywood Patch reports: "Lutton was booked on state charges in connection with [the] attempted armed robbery and is expected to be booked on federal charges stemming from the other two bank robberies."

Officer's Observations Help Apprehend a Burglary of Motor Vehicle Suspect

Aware of a crime trend of motor vehicle theft of Dodge Chargers in the area, Andrews International Officer David Akimoto affixed property CCTV cameras on vehicles of that make and model throughout the shopping center in Honolulu, Hawaii. While reviewing the camera footage on duty, he recalled a risk factor that made him suspicious of a Toyota Tacoma pickup truck, white in color, parked next to a Dodge Charger in the parking lot. His suspicions were confirmed when a passenger stepped out of the pickup truck, accessed the trunk of the Charger and began removing items from the vehicle. Read full story.
